1) Acceptance

By accessing our website or placing an order (the “Services”), you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

2) Eligibility & Accounts

You must be 16+ (or the age of majority in your jurisdiction) to purchase. You’re responsible for the accuracy of your data and for keeping your account secure.

3) Products, Pricing & Availability

We aim to display product details accurately; minor variations in color/finish can occur due to screens and production.
Prices are shown in ‹MXN/USD› and may include/exclude taxes as indicated at checkout.
We may update prices, run promotions, or discontinue items at any time. In case of obvious pricing errors, we may cancel and refund.

4) Orders & Payments

Your order is accepted when you receive our order confirmation email.
Payments are processed via third-party payment gateways; anti-fraud checks may apply.
If an item becomes unavailable after purchase, we’ll notify you for a refund or alternative.

5) Shipping

We ship to Mexico and the United States (and other countries when stated).
Estimated costs and delivery times are shown at checkout. Customs duties/taxes (if any) are paid by the customer.
Risk of loss passes to you upon delivery to the carrier. Please inspect packages on arrival and report issues promptly.

6) Returns, Exchanges & Cancellations — All Sales Final (No Refunds / No Exchanges)

All sales are final. We do not offer refunds, store credit, or exchanges.
Personalized / made-to-order items: also non-returnable and non-exchangeable.
Damaged or defective on arrival (DOA): Email ‹midnightbrandofficial@gmail.com› within 7 days of delivery with your order number and photos. Where required by non-waivable consumer law, we will repair or replace the item (and comply with any mandatory remedies).
Cancellations: Not accepted once an order enters production/fulfillment. If you contact us immediately after purchase, we’ll try to help only if processing hasn’t started.
Mandatory consumer rights: If your jurisdiction (e.g., certain EU countries or U.S. states) grants additional non-waivable rights, we will comply as required by law.

7) Warranty

Covered for ‹30/90 days› against manufacturing defects. Not covered: normal wear, misuse, improper care/washing.

8) Intellectual Property

All designs, artwork, trademarks, photos, text, and site content are owned by Midnight or its licensors. No copying, resale, or derivative use without written permission.

9) User Content (Reviews, Photos)

By submitting content, you grant Midnight a worldwide, non-exclusive, royalty-free license to use, reproduce, modify and display it for marketing and commercial purposes, subject to our Privacy Policy.

10) Acceptable Use

Do not use the Services for unlawful activities, to infringe rights, distribute malware, scrape or mine data, or disrupt operations.

11) Limitation of Liability

To the maximum extent permitted by law, Midnight is not liable for indirect, incidental, special, or consequential damages (including lost profits). Our total liability for any claim relating to a purchase is limited to the amount you paid for that order. Nothing here limits consumer rights that cannot be waived by law.

12) International Consumer Notices

EU: You may have a 14-day right of withdrawal for distance sales, except for customized/personalized items.
US (incl. California): We honor applicable consumer rights; see our Privacy Policy for CCPA/CPRA opt-out choices.
These Terms don’t restrict mandatory consumer rights in your jurisdiction.

13) Third-Party Services & Links

We are not responsible for third-party websites or services linked from our site (payment, analytics, shipping, printing/fulfillment partners).

14) Changes to Terms

We may update these Terms periodically. The Effective date above will reflect the latest version. Continued use after changes means acceptance.

15) Governing Law & Venue

These Terms are governed by the laws of Mexico. Disputes may be brought before the courts of ‹Mexico City (CDMX)›, without prejudice to any non-waivable consumer protections in your place of residence.
